Seneca Iron Works, LLC, Seneca Dairy Systems, LLC and ZM Industries, LLC, will hereafter be referred to as “Seneca”

TERMS AND CONDITIONS OF SALE

RETURNED OR BOUNCED CHECK FEE

There will be a $50.00 service fee for any check returned to Seneca for insufficient or unavailable funds.

ORDER CHANGES

Seneca will honor changes to an existing order, provided the individual making the amendments is the same person who placed the initial order.

DISCOUNTS

Seneca reserves the right to amend and/or change its discount structure for, but not limited to volume discounts, contractor or dealer discounts and cash or early pay discounts. Customer must be current within his/her terms to receive discounts of ANY kind. All payments made to Seneca will be applied to past due invoices first.

TAX EXEMPTION

By law, Seneca MUST charge State and Local taxes on your purchases. If you qualify for tax exemption under state or federal law, we can only remove sales tax IF we have a valid and complete tax exemption form on file. All exemption forms must be COMPLETE and signed. In the event Seneca invoices a purchase without tax and in the absence of a valid and completed State Tax Exemption form, the customer will have 30 days to submit said exemption form to Seneca. If the customer fails to produce a valid, completed form within the 30 day period, Seneca will invoice the customer the amount of the unpaid taxes, which will be due immediately upon receipt of the invoice. Federal law requires Seneca Dairy Systems LLC to notify you that customers who purchase items under a qualifying tax exemption may be liable for a federal use tax on those items.

DISPUTES

In the event that the customer disagrees with an invoiced amount, he/she must notify Seneca of the disputed issue within fifteen (15) days of the invoice date; either by email to disputes@senecadairysystems.com or certified letter. All undisputed invoices will be deemed “agreed upon” by the customer after fifteen calendar days from the invoice date and full payment will be due within the terms as issued by Seneca.

UNPAID INVOICES

Any invoice 15 days overdue will be considered delinquent and subject to a 2% per month interest charge. In the event it should be necessary to place a customer’s account with an attorney for collection, the venue shall be in Seneca County, New York State and all questions and discrepancies shall be governed by New York State laws. Customer will be responsible for all costs and fees expended by Seneca in its efforts to collect unpaid invoices, including, but not limited to, costs of suit, attorneys’ fees, and collections charges.

RETURN POLICY

Our goal at Seneca is to provide our customers with the highest quality products at a fair and reasonable price. We strive to make every item we fabricate perfect; every time. In the unlikely event you receive a Seneca product that is defective or doesn’t meet Seneca’s high standards, we will replace, repair or refund the item 100%.

Seneca will also honor returns on items that were over purchased or purchased in error in accordance with the following guidelines:
1.   All returned items MUST be matched to an original invoice/order with NO EXCEPTIONS.
2.   All returns must be made within 90 days of the date of the original purchase.
3.   Items to be returned must be in their original purchase condition. (un-used and in its original packaging, clean and free of
manure, dirt or bird droppings, etc.)
4.  If any of the above requirements are not met (1-3) then a minimum 30% restock fee will be assessed. Additionally, these
returns may take up to 7-10 days to process. Since Seneca offers volume and packaging discounts, this time will allow us
to review each account individually so that we can determine the highest credit return for the customer. We appreciate
your patience.
5.  Individual items that were purchased as part of a kit or package will not be credited at full retail if the complete kit or
package is not returned as a whole.
6.  Some items are not eligible for a return for credit and thus, all sales are final on these items. These items include, but are
not limited to; electronics, any item not currently listed as a common or stock item such as custom bent free stall loops, etc.,
scrap or surplus steel, any cut or partial item such as partial lengths of steel, curtain fabric, alley matt, wire, etc. or any
special order or custom made items.
Seneca will have the final decision on all returns and reserves the right to refuse a return for, but not limited to, any of the above reasons.
